These Terms of Service ("Terms") govern your access to and use of the Spoken: Smart AI Translator mobile application and related services (collectively, the "Service"), provided by Tenet Oyun Yazılım ve Pazarlama Ltd. Şti.("Company," "we," "us," or "our").

BY DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING SPOKEN, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT DOWNLOAD, INSTALL, OR USE THE SERVICE. USE OF THE SERVICE IS VOID WHERE PROHIBITED.

1. The Service

1.1 Description
-
Spoken provides real-time transcription and translation of speech, live captions, remote conversation ("Live Link" / "Listen Mode"), photo translation, text translation, and AI rewriting. The Service relies on third-party artificial intelligence and speech APIs (including, without limitation, speech-to-text, translation, and neural voice providers) to process audio and text input and return text and audio output.

1.2 "AS IS" and "AS AVAILABLE"

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. It may contain errors or inaccuracies and may experience interruptions. We strongly encourage you to save or back up any output you wish to keep before relying on it.

1.3 Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part or feature of it), temporarily or permanently, at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

1.4 Updates to These Terms

We may update these Terms from time to time. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.

2. Subscriptions, Free Access, and Billing

2.1 Free Access

New users receive a limited, one-time allowance of live voice/conversation translation (currently five (5) minutes total) so they can try the Service before subscribing. This allowance is a promotional in-app feature — not a free trial of any subscription and not an auto-renewing introductory offer. Additional free features (such as text translation, AI rewriting, and photo translation) are available subject to the daily quotas and fair-use limits shown in the app. We reserve the right to change these free allowances, or to limit the speed or availability of free features during peak load.

2.2 Subscription Plans

We offer paid subscription tiers (for example, weekly, monthly, and annual plans) that unlock the Service's premium features. The exact plans, prices, billing periods, entitlements, and any Neural Audio allowances are clearly displayed at the point of purchase and take precedence over any examples in these Terms. Prices and entitlements are subject to change to the maximum extent permitted by law, with any change communicated at the time of purchase or renewal.

2.3 Payments and Automatic Renewal

All purchases are processed by the Apple App Store or Google Play Store (the "App Stores"), not directly by us. Payment is charged to your App Store account (e.g., your Apple Account) at confirmation of purchase. Your subscription renews automatically at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your App Store account settings.

2.4 Refunds

All billing is handled by the App Stores, and we do not process refunds directly.

Weekly and monthly plans: Refunds are subject to Apple's and Google's standard policies.

Annual plans: By selecting an annual plan to secure a discounted rate (e.g., "Save 36%"), you acknowledge that this is an upfront commitment. Refunds for unused periods are generally not granted, except where required by mandatory applicable law (including any non-waivable consumer withdrawal or cancellation rights in your jurisdiction).

3. Fair Use Policy and Usage Limits

To maintain quality for all users and to prevent abuse of our high-cost neural audio and streaming infrastructure, all use of the Service is subject to this Fair Use Policy. Where any feature is described as "unlimited," this means unlimited for normal, reasonable, interactive use and remains subject to the limits below.

3.1 Neural Audio Allowances

"Neural Audio" refers to human-like, high-definition voice output (powered by third-party neural voice providers). Paid plans include a monthly soft allowance of Neural Audio processing, shown at purchase (for example, a higher allowance on higher tiers and a standard allowance on lower tiers).

3.2 Overage and Graceful Fallback

If you exceed your Neural Audio allowance in a billing cycle:

The Service will not stop working.

We reserve the right to switch your audio output from Neural (High Definition) to Standard (Standard Definition) for the remainder of that cycle.

Standard Definition audio remains available to paid subscribers for the rest of the cycle, subject to fair use.

3.3 Interactive, Human Use Only

The Service is intended for interactive, real-time, personal or professional use by humans. Automated, systematic, scripted, or bot-driven usage, and commercial broadcasting, are not supported and may degrade performance. We reserve the right to implement technical measures to detect and prevent such usage.

3.4 Abuse Threshold and Enforcement
-
Sustained use of "Live Link" / "Listen Mode" beyond a reasonable human threshold (currently approximately 2,400 minutes / 40 hours per month) is considered abnormal and indicative of non-human or non-permitted use. More generally, we may apply usage limits, throttling, quality reduction, temporary suspension, or account termination where your usage is excessive, abusive, automated, shared across multiple users, resold, or otherwise materially impacts the stability, performance, cost, or availability of the Service. Fair-use limits may be updated from time to time in response to technical, operational, third-party provider, or business requirements.

4. Live Link and Remote Features

4.1 Beta Nature

"Live Link" (connecting two remote devices) relies on WebSocket connections and public internet stability. We do not guarantee zero latency or an uninterrupted connection, as these depend on network conditions outside our control. Features may be offered on a beta basis and may change or be withdrawn.

4.2 Consent to Transmission

By using Live Link, you consent to the real-time transmission of your audio and transcribed text to the connected recipient's device. You are responsible for ensuring you have any consent required to record, transcribe, or transmit the speech of others.

5. Content, Conduct, and Data

5.1 Your Content

"Content" means any information generated or encountered through the Service, including audio input and text output. You are solely responsible for the Content you submit for processing.

5.2 Prohibited Content and Conduct

You agree not to use the Service to process or submit Content that is illegal, defamatory, obscene, or infringing; that violates any third-party right or any applicable law or regulation; that invades another's privacy; or that contains malicious software. You agree not to attempt to disrupt, reverse-engineer, or circumvent the Service or its usage limits.

5.3 Audio Handling and Data Storage

Audio submitted for real-time processing is processed transiently by us and our third-party processors and is not stored permanently on our servers. Transcriptions and translations you save are stored on your device and may be backed up to your own iCloud or equivalent account as part of your device backup settings. You are responsible for managing and backing up any Content important to you; if you delete the app, delete a history item, clear local data, lose access to your device, or remove the relevant backup, we cannot recover that Content. 6. License

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to use the Spoken application as provided to you as part of the Service and in accordance with these Terms. All rights not expressly granted are reserved.

7. Disclaimers and Limitation of Liability

7.1 Accuracy of Translation

The Service uses artificial intelligence and third-party services to generate automated transcription and translation. AI is not infallible, and output is not 100% accurate. Accuracy varies with audio quality, accents, background noise, technical conditions, and language complexity. You acknowledge that output may contain an error rate of approximately 5–10% or more, including errors, omissions, mistranslations, and misinterpretations. You are solely responsible for reviewing and verifying output before relying on it.

7.2 No Reliance in High-Risk Situations

The Service is provided for informational and convenience purposes only and must not be relied upon for high-stakes situations, including but not limited to medical emergencies, legal proceedings, air traffic control, financial decisions, or critical safety instructions. The Service is not a substitute for a qualified human translator or interpreter where accuracy is critical. We accept no liability for any consequences arising from reliance on the Service's output.

7.3 Warranty Disclaimer

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.4 Limitation of Liability

To the maximum extent permitted by applicable law, Tenet Oyun Yazılım ve Pazarlama Ltd. Şti. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service, including damages arising from transcription or translation errors, service interruptions, or data loss. Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months prior to the event giving rise to the claim.

8. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the competent courts of Istanbul, Türkiye, without prejudice to any mandatory consumer-protection rights available to you under the law of your place of residence.
