Terms Of Service

These Terms of Service ("Terms") govern your access to and use of the Lingua: Smart AI Translator mobile application and related services (collectively, the "Service"), provided by Tenet Oyun Yazilim ve Pazarlama Limited Sirketi("Company," "we," or "us").

By creating an account or accessing the Service, you agree to be bound by these Terms.

1. SUBSCRIPTIONS AND BILLING

1.1. Subscription Plans

We offer the following subscription tiers. Prices and entitlements are subject to change but will be clearly communicated at the time of purchase:

  • Traveler (Weekly): Billed weekly. Includes limited Neural Voice credits.

  • Pro (Monthly/Yearly): Billed monthly or annually. Includes standard daily allowance of Neural Voice credits.

  • Max (Monthly/Yearly): Billed monthly or annually. Designed for heavy usage (meetings, long-form listening) with a high volume of Neural Voice credits.

1.2. Free Tier

The Free Tier provides unlimited text translation and AI rewriting. Photo translation is limited to a specific daily quota (e.g., 10 photos/day). We reserve the right to limit the speed or availability of free features during peak load.

1.3. Payments & Renewals

All purchases are processed through the Apple App Store or Google Play Store ("App Stores"). Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

1.4. Refund Policy

All billing is handled by the respective App Store. We do not process refunds directly.

  • Weekly/Monthly Plans: Refunds are subject to Apple/Google standard policies.

  • Yearly Plans: By selecting a Yearly plan to secure the discounted rate (e.g., "Save 36%"), you acknowledge that this is an upfront commitment. Refunds for unused months are generally not granted except where required by local law.

2. FAIR USE POLICY AND USAGE LIMITS

To ensure the highest quality of service for all users and to prevent abuse of our high-cost Neural Audio infrastructure, usage is subject to the following Fair Use Policy:

2.1. Neural Audio Credits

"Neural Audio" refers to the human-like, high-definition voice output (Powered by Deepgram Aura/Google Neural).

  • Max Plan Limit: Users on the 'Max' plan are allocated a soft cap of 600 minutes (10 hours) of Neural Audio processing per monthly billing cycle.

  • Pro Plan Limit: Users on the 'Pro' plan are allocated a soft cap of 150 minutes (2.5 hours) per monthly billing cycle.

2.2. Overage and Fallback

If you exceed your allocated Neural Audio limit:

  • The Service will NOT stop working.

  • We reserve the right to automatically switch your audio output from "Neural" (High Definition) to "Standard" (Standard Definition) for the remainder of the billing cycle.

  • Standard Definition audio is unlimited for paid subscribers.

2.3. Abuse and Bot Protection

The Service is for human, personal, or professional use only.

  • Live Link Excessive Use: Usage of the "Live Link" or "Listen Mode" exceeding 2,400 minutes (40 hours) in a single month is considered abnormal and indicative of non-human usage (bots, automated scraping, or commercial broadcasting).

  • Consequences: We reserve the right to throttle bandwidth, temporarily suspend, or permanently terminate accounts found to be exceeding the 40-hour threshold to protect our infrastructure.

3. LIVE LINK AND REMOTE FEATURES

3.1. Beta Nature

The "Live Link" feature (connecting two remote devices) relies on WebSocket connections and public internet stability. We do not guarantee zero-latency or uninterrupted connection, as these depend on network conditions outside our control.

3.2. Data Transmission

By using Live Link, you consent to the real-time transmission of your audio and transcribed text to the recipient's device. Audio is processed transiently and is not stored permanently on our servers.

4. DISCLAIMERS AND LIMITATIONS

4.1. Accuracy of Translation

The Service uses artificial intelligence (AI) for translation. AI is not infallible. The Service should not be used for high-stakes situations, including but not limited to: medical emergencies, legal proceedings, air traffic control, or critical safety instructions. We accept no liability for errors in translation.

4.2. "AS IS" Basis

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, whether express or implied, including warranties of merchantability or fitness for a particular purpose.

4.3. Limitation of Liability

To the maximum extent permitted by law, Tenet Oyun Yazilim ve Pazarlama Limited Sirketi shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve (12) months prior to the claim.

5. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions. Any disputes shall be resolved in the competent courts of Istanbul, Türkiye.
