Terms and Conditions

These Terms of Service ("Terms") govern your access to and use of the Lingua: Smart AI Translator mobile application and related services (collectively, the "Service"), provided by Tenet Oyun Yazilim ve Pazarlama Limited Sirketi ("Company," "we," or "us"). By downloading, accessing, or using the Service, you agree to be bound by these Terms.

 

1. ELIGIBILITY

 

You must be at least 13 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you have the legal capacity to enter into a binding agreement.

 

2. YOUR ACCOUNT

 

You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use.

 

3. SERVICE PLANS & TRIALS

 

We offer different tiers of service, each with its own features and limitations.

3.1 Free Trial ("Trial Tier") Upon creating an account, you will receive a one-time, limited-use free trial to evaluate the Service.

  • Usage: The Trial is limited to approximately 3 minutes of translation time. A progress bar in the app will indicate your remaining trial usage.

  • Expiration: Once you consume your allotted trial usage, the trial will end, and you will be required to upgrade to a paid subscription to continue using the core features.

  • No Obligation: The Trial Tier does not require a payment method to start.

3.2 Paid Subscriptions ("Paid Tiers") We may offer various paid subscription plans (e.g., "Traveler," "Pro") which are billed on a recurring basis (e.g., monthly, annually) through your mobile platform's app store (Apple App Store or Google Play).

  • Payment & Renewal: Payments will be charged to your app store account at confirmation of purchase. Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

  • Cancellation: You can manage and cancel your subscription at any time through your app store account settings. Cancellation will take effect at the end of the current billing period. We do not provide refunds for partial billing periods.

 

4. FAIR USE POLICY AND USAGE LIMITS

 

We are committed to providing a high-quality experience for all users. To prevent abuse and ensure the sustainability of our Service, all accounts are subject to a Fair Use Policy and automated usage limits. Usage is reset on a monthly basis.

4.1 Usage Units: Usage is tracked in "Cost Units" based on the duration of your audio inputs and the length of the text outputs generated by our AI models.

4.2 Paid Tier Limits:

  • Traveler Plan: This plan is designed for typical, personal use. It has a soft usage limit of approximately 10 hours of translation per month.

    • Exceeding the Limit: If you exceed this limit in a given month, the Service will automatically downgrade the text-to-speech (TTS) voice quality from our premium cloud voice to a standard, on-device voice for the remainder of the month.

  • Pro Plan: This plan is marketed as "unlimited," but this is subject to a fair use policy designed to prevent commercial or automated abuse. It has a soft usage limit of approximately 6 hours of translation per month for the highest quality output.

    • Exceeding the Limit: If you exceed this limit in a given month, the Service will automatically downgrade the TTS voice quality from our highest-quality neural voice to a standard cloud voice for the remainder of the month.

  • Fair Use Cap: Usage that we deem excessive and indicative of non-personal abuse (e.g., automated processes, commercial broadcasting) may be subject to throttling, suspension, or termination at our sole discretion.

 

5. PROHIBITED CONDUCT

 

You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation.

  • To interfere with or disrupt the integrity or performance of the Service or its data.

  • To attempt to gain unauthorized access to the Service or its related systems or networks.

  • To use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission.

  • To generate content that is illegal, harassing, defamatory, obscene, or otherwise objectionable.

 

6. INTELLECTUAL PROPERTY

 

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Tenet Oyun Yazilim ve Pazarlama Limited Sirketi and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

 

7. PRIVACY AND DATA STORAGE

 

Your privacy is important to us. Our Privacy Policy, which is incorporated by reference into these Terms, explains how we collect, use, and disclose information that pertains to your privacy.

7.1 Local Data Storage We value the privacy of your communications. We do not store, record, or archive the content of your conversations, audio inputs, or translated text on our servers. All translation history and session data are stored locally on your device. Because this data is not synced to our servers, we do not have access to your private conversations, and we cannot recover this data if you delete the application or clear your device storage.

 

8. DISCLAIMERS & LIMITATION OF LIABILITY

 

No Warranty: THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT TRANSLATIONS WILL BE ACCURATE.

AI Limitations: You acknowledge that the Service uses artificial intelligence and machine learning, which are probabilistic systems. Translations may not always be accurate, appropriate, or complete. You should not rely on the Service for critical communications (e.g., medical, legal, or emergency situations).

Limitation of Liability: IN NO EVENT SHALL TENET OYUN YAZILIM VE PAZARLAMA LIMITED SIRKETI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

 

9. CHANGES TO TERMS

 

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page with a new "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

 

10. GOVERNING LAW AND DISPUTE RESOLUTION

 

These Terms shall be governed by and construed in accordance with the laws of Türkiye, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Istanbul, Türkiye.
